These Terms of Service ("Terms") govern your access to and use of services provided by Circle Living ("we," "our," or "us"). By engaging with our services, you agree to be bound by these Terms and our Master Service Agreement, if applicable.
1. Scope of Services
Circle Living provides premium towel products and related services. These may include, but are not limited to:
E-commerce website management and optimization
Social media advertising (e.g., Meta Ads)
Email and SMS marketing campaigns
Customer relationship management (CRM) system setup and automations
Product promotion and brand positioning
Performance tracking and analytics
Exact deliverables and timelines will be defined in a separate written agreement or scope of work.
2. Client Responsibilities
To perform services effectively, clients must provide:
Access to their Meta ad account
Website and e-commerce platform access (e.g., Shopify, WooCommerce)
Business details, brand materials, and any relevant assets or logins
Failure to provide necessary access or information may delay service timelines and impact performance.
3. Fees & Payment
Payment structure varies per client based on agreed-upon terms. We may charge:
Monthly retainers
One-time fees with performance-based incentives
Custom project-based pricing
All fees are specified in the signed service agreement or invoice. No refunds will be issued under any circumstances.
4. Cancellations & Termination
Clients may cancel their services in accordance with the terms of their individual contracts. If no term is specified, services may be canceled with written notice. Work performed prior to cancellation will still be billed.
We reserve the right to terminate services at any time due to nonpayment, breach of agreement, or abusive conduct.
5. No Guarantees or Promises
Circle Living does not guarantee specific results, sales, return on ad spend, or lead volume. While we use proven strategies and systems, marketing outcomes depend on various factors beyond our control.
6. Data & Confidentiality
We may collect and store client data in our CRM systems for service delivery purposes. All business information shared with us is treated as confidential. However, we reserve the right to use anonymous performance data for internal analysis and marketing case studies unless explicitly restricted by contract.
7. Marketing Use
By working with Circle Living, you grant us the right to use non-confidential aspects of your results (e.g., ad screenshots, ROI stats, creatives) in marketing materials, unless otherwise agreed upon in writing.
8. Legal Compliance
We handle all ad compliance and legality issues related to Meta’s advertising policies, terms of use, and other relevant platforms. However, clients remain responsible for the truthfulness of all claims, testimonials, and offers submitted for use in campaigns.
9. Intellectual Property
All creative assets, ads, funnels, and systems developed for the client are the property of the client upon full payment unless otherwise stated in the contract. Circle Living retains the right to repurpose non-exclusive frameworks and strategies.
10. Limitation of Liability
Circle Living will not be liable for indirect, incidental, or consequential damages resulting from service use or failure. Our total liability will not exceed the amount paid to us in the three months prior to any claim.
11. Governing Law
These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law principles.
